The rapid pace of change and technological advancement in the gaming industry has created an increasingly complex and ever changing legal and regulatory environment, not only in Canada, but across the world. The 2012 Canadian Gaming Summit Legal and Regulatory program brought together the industry’s leading lawyers, regulators and gaming executives who examined and engaged attendees on today’s most important legal and regulatory issues.

The 2012 Legal & Regulatory track was Chaired by Danielle Bush, Partner at Chitiz Pathak LLP Barristers and Solicitors & Michael D. Lipton, Q.C, a senior partner of Dickinson Wright LLP.

For over 20 years, he has served as senior counsel on several gaming law matters and acts as senior counsel in advising gaming license holders throughout North America on gaming compliance and policy issues.

3:10 – 4:00pm Provincial Monopolies - Is it time for a change or are they best for Canada?

Several countries such as the U.K., U.S. and Australia, like Canada, have undergone huge expansion in gaming in the last 20-30 years, and Canada is the only one of those countries where all gaming and betting involves a transaction with agents of the state. With Canada being the only one of those countries that has not convened a national review of the consequences in gaming expansion, this session will explore a connection between these facts and act as a dialogue on the development of provincial monopolies and their benefits, as well as highlight business models in other jurisdictions and what they bring to the table.

2:10 – 3:00pm Sports Betting Legislation and Regulation

In a major amendment to Canadian gaming legislation, the Criminal Code will shortly permit single-event sports betting in Canada.  Canadian casinos will therefore be able to offer bettors the ability to place single bets on the biggest sports events of the year. It is expected that this will lead to increased scrutiny of sportsbetting activities and potential match-fixing in Canada.  This process is already well developed in Europe and Australia as sports betting has come under a microscope internationally as a result of escalating issues around integrity. As well, sportsbetting remains a hotly contested issue in the United States (most recently in New Jersey) raising questions about the likely development of the law governing sportsbetting in the States over the next few years.

3:10 – 4:00pm The Elephant in the Room - A Toronto Casino?

This session will cover the debate currently ongoing as to the benefits and the possibility of a Toronto Casino. Several aspects of the debate will be discussed including the City of Toronto  plebiscite, how the public debate is developing, how the 2012 OLG Strategic Business Review supports the concept of a Toronto Casino, and what has changed since 2005 when the provincial government declared a moratorium on new casino development.

10:10am -11:00am Worldwide iGaming Regulation

The legality and regulation of iGaming still varies tremendously from country to country.  In this session, a broad overview of the status of iGaming and iGaming regulation in the European Union and the United States will be provided.  We will hear from a senior officer from Denmark’s gaming regulator regarding the sweeping changes that have taken place in that country’s regulation of iGaming as well as a description of the present private operator licensing protocol in place. We will also receive an update on US developments in the possible regulation of iGaming federally and on a state by state basis.

A panel discussion on how the globalization of gaming is changing the face of regulation and what this means for the strategic direction of regulation across Canada. The panel will discuss topics such as: opportunities for national compliance, ensuring continued protection of the public, fostering business, impact of online gaming, operating globally and thinking locally, and risk based regulation. The panelists will share their experiences, insights and lessons learned  with an open Q&A session for the last 10 min.

3:40pm - 4:30pm US Gaming Law Update

The panel will consider recent developments in U.S. gaming law, and the potential implications for the Canadian gaming industry.  The Keynote Speaker, Lawrence Walters, will evaluate the continuing efforts toward intrastate online gaming legalization, as well as planned state-by-state expansions in land-based gaming.  The regulatory challenges posed by technological advancements in gaming software and delivery systems will be explored, and potential licensing criteria critiqued.  The discussion will also include topics such as tribal gaming, sweepstakes cafes, and advertising law.  The panelists will compare and contrast legal treatment of these emerging issues under U.S. law as compared with Canadian law.  Important gaming issues will be analyzed through the lenses of the U.S. Constitution and the Canadian Charter of Rights and Freedoms.
